IN THE MATTER OF THE APPLICATION FOR THE INCORPORATION OF THE TOWN OF
CENTERTON, BENTON COUNTY, ARKNow on this 7th day of August, 1914, this cause came on for final
hearing: and, it appearing to the Court that the petition for the incorporation
of the Town of Centerton, Benton County, Arkansas, was filed in this Court on
the 27th day of May, 1914, and that on the 6th day of
June, 1914, a day of the regular term of this Court, the prayer of said petition
was granted and the hearing of the petition was set for July 6th,
1914, and that the petitioners were required to give notice by publication in a
newspaper published and of general circulation in Benton County, Arkansas for
three weeks before said time: and, it further appearing to the Court that on
July 6th, 1914, the day set for the hearing of said petition, that
E. T. Gravette, A. L. Kirby, J. F. Mackey, W. F. Mackey, F. B. Lewis, R. L.
Fair, J. A. Fair, E. H. Fair, E. Wright, J. J. Coley, R. O. Chambers, James W.
Womack, A. K. Kirby, John A. Womack, W. B. Womack, D. F. Morris, E. C. Mayo,
Julia Fair and Lulu Chambers filed their motion to be made parties herein
and also filed their general and separate answers herein, and also filed their
motion to strike the names of certain petitioners from the petition: and, it
further appearing to the Court that said cause was, by consent of the
petitioners and said remonstrants or parties, continued until the 28th
day of July, 1914, and that on said 28th day of July, 1914, the same
was, by consent of all parties continued until this day: and all parties,
petitioners and remonstrants, appeared on this day and announced ready for
hearing, - both parties being represented by counsel and by their respective
agents; and, the Court finds from the evidence that notice of the filing of the
petition herein was given by publication in a newspaper in all respects and for
the full length of time required by law; and, the Court further finds that more
than twenty qualified voters reside within the limits described by said
petition, and that said petition has been signed by them and that said limits
have been accurately described and an accurate map or plat made and filed; and,
the Court further finds that the name of Centerton, the same being the name
proposed for said Town, is proper and sufficient to distinguish if from other of
like kind in the State; and, the Court further finds that it is the right and
proper that said petition shall be granted, and said territory incorporated into
a municipal corporation.
It is therefore considered, ordered and adjudged by the Court that the
following described territory situated in Benton County, Arkansas, to-wit:
Beginning at the North West Corner of the North East quarter of the South West
Quarter of Section 33, in Township 20 North, Range 31, West, and running thence
South forty rods, thence West Forty rods, thence South one hundred and twenty
rods to the South line of Section 33, thence East along the said South line of
Section 33 eighty rods, thence South 40 rods, thence East 40 rods, thence North
40 rods to the South line of said Section 33, thence East along the South line
of said Section 33, thence North 40 rods to the place of beginning, - be and
the same is hereby organized and permitted to be organized into the incorporated
town of Centerton, Benton County, Arkansas, as named and described in said
petition and that the prayer of said petition be in all things granted.
It is further ordered that the petition and map or plat be delivered to the
recorder of Benton County and that he shall record the same as soon as may be
(?) in
the proper book of record and file and preserve in his office the original
papers after having certified thereon that the same have been properly recorded;
and, said recorder shall make out and certify under his official seal two
transcripts of said record, - one of which he shall forward to the Secretary of
State and the other of which eh shall deliver to the agent or agents of the
petitioners with his certificate that a similar transcript ahs been forwarded to
the Secretary of State as provided by Section 5576 of Kirby’s Digest; that as
soon as said record shall be made and said transcript forwarded and delivered,
the inhabitants within the limits described in the petition, shall be deemed an
incorporated town under the name of the Town of Centerton to be organized and
governed in the manner provided by law, - and, there upon came the remonstrates
herein and filed their affidavit for an appeal, which is by the Court granted..

I, W. M. Heaslet, the duly commissioned and acting Clerk of the Circuit Court
and Ex officio Recorder of Benton County, Arkansas, do hereby certify that the
above and foregoing is a true and correct transcript of an order and judgment
and record of the County Court of Benton County, Arkansas, organizing the
territory described therein into an incorporated town under the name of Town of
Centerton, Benton, County, Arkansas, as the same appears of record in my office
as prescribed by section 5576 of Kirby’s Digest of the Statutes of Arkansas.
